  2008 Lead Standard Boundary Recommendation

On Oct. 15, 2008, the U.S. Environmental Protection Agency promulgated a revision to the National Ambient Air Quality Standard for lead. The state then had one year to develop a recommendation as to which areas of the state should be designated nonattainment for the new lead standard. Once approved by the commission, this recommendation will be forwarded to the governor for submittal to EPA. The new standard for airborne lead is 0.15 micrograms per cubic meter, calculated as three-month, rolling averages.

The proposed rulemaking will update the incorporation by reference date in the definitions section to match recent revisions to the Code of Federal Regulations or CFR that excludes stationary, fossil-fuel fired combustion turbines from the cogenerator exemption in the federal Clean Air Interstate Rule or CAIR.  This rulemaking adopts changes to the federal rule into the state rule.  In addition, facility identification numbers in the tables will be updated to correspond with current identification codes.
