10 CSR 10-6.390 Control of NOx Emissions From Large Stationary Internal Combustion Engines

This proposed rulemaking will amend the rule by including emission rate limitations for both large stationary diesel and dual fuel internal combustion engines to be consistent with the federal Phase II NOx State Implementation Plan call and add a NOx exemption limit. Comments will be accepted on these rule actions through Dec. 10, 2009.

10 CSR 10-6.070 New Source Performance Regulations

This proposed amendment updates the 40 CFR part 60 promulgation date to Dec. 31, 2008, and incorporates by reference six new subparts finalized between July 1, 2006 and December 31, 2008.  Additionally, this amendment updates 11 previously adopted subparts with minor U.S. Environmental Protection Agency changes. Comments will be accepted on these rule actions through
Dec. 10, 2009.

10 CSR 10-6.075 Maximum Achievable Control Technology Regulations

This proposed amendment updates the 40 CFR part 63 promulgation date to Dec. 31, 2008 and incorporates by reference 22 new subparts finalized between July 1, 2006 and December 31, 2008.  Additionally, this amendment updates 32 previously adopted subparts with minor EPA changes. Comments will be accepted on these rule actions through Dec. 10, 2009.

10 CSR 10-6.080 Emission Standards for Hazardous Air Pollutants

This proposed amendment updates the 40 CFR part 61 promulgation date to Dec. 31, 2008.  No new or amended federal subparts were promulgated between July 1, 2006 and December 31, 2008. Comments will be accepted on these rule actions through Dec. 10, 2009.

10 CSR 10-6.010 Ambient Air Quality Standards

This proposed amendment will update the standards for ambient air quality throughout Missouri in order to reflect the changes in the National Ambient Air Quality Standards for particulate matter 10 microns or less, particulate matter 2.5 microns or less, ozone and lead.  These standards are federally mandated.  The Clean Air Act requires the EPA to review the NAAQS once every five years.  These new and revised standards are based on the most recent health studies available to the EPA and set national levels for acceptable concentrations of specific pollutants in the ambient air. Comments will be accepted on these rule actions through Dec. 10, 2009.

10 CSR 10-6.040 Reference Methods

This proposed amendment will update the reference methods for measuring and complying with the new NAAQS for ozone and lead.  All reference methods found in 40 CFR Part 50 Appendices A-R would be incorporated by reference in this rule as well as the equivalent methods found in 40 CFR part 53.  The rule would then reflect the most current effective dates for the Code of Federal Regulations.  Effective dates are currently referred to in Rule 10 CSR 10-6.070, but by moving the incorporation by reference to this rule, the Code of State Regulations will be less confusing. Comments will be accepted on these rule actions through Dec. 10, 2009.

10 CSR 10-6130 Controlling Emissions During Episodes of High Air Pollution Potential

This proposed amendment will update the breakpoint values in Table A for the Air Quality Index.  This rulemaking is necessary because when the eight hour ozone NAAQS was revised by the EPA in March of 2008 and the break point values for the air quality index were also updated. Comments will be accepted on these rule actions through Dec. 10, 2009.
