Recommended Action:The Commission to approve Finding of Necessity to allow the Department of Natural Resources to file a proposed rule package to incorporate the Tank risk-based corrective action into the Code of State Regulation.
- Adoption of Orders of Rulemaking – Tim Eiken, Rules Coordinator, HWP.
Recommended Action: The Commission to approve Orders of Rulemaking to adopt the 13 amendments to Title 10, Division 25 of the Code of State Regulations published in the November 17, 2008, Missouri Register.
- Continental Cement Company, LLC., Variance Petition – Robert Clay, Environmental Engineer, Permits Section, HWP.
Recommended Action:The Commission to vote on the variance request for the Continental Cement Company, LLC.
- BASF, Variance Petition – Theresa Doggett, Planner, Permits Section, HWP.
Recommended Action:The Commission to vote on the variance request for the BASF Corporation. .
- U.S. Fuels LLC (ST10664) – Heather Peters, Environmental Specialist, Compliance and Enforcement Section, HWP.
Recommended Action:The Commission to refer U.S. Fuels LLC. (ST0010664), to the Attorney General’s Office in order to compel compliance and pursue and negotiate a civil penalty.
