Exide Technologies filed a Notice of Appeal and Motion to Stay with the Administrative Hearing Commission regarding
specific conditions in their
Missouri Hazardous Waste Management Facility Part I Permit
and has asked, through a motion of stay, the effective date of these permit conditions be delayed until there is a final judgment on the appeal. Exide is not appealing the entire permit, only specific conditions of the permit. The department issued the hazardous waste permit on Sept. 23, 2009.
The Administrative Hearing Commission held a hearing on the Motion for Stay on Tuesday, Dec. 1, 2009 and scheduled a one-day evidentiary hearing for the appeal for Friday, Feb. 5, 2010. The Department is currently working with Exide to find a solution without the need for an evidentiary hearing. Both the Department and Exide requested the Commission continue the hearing; however rather than set a new hearing date, we have requested that the Commission allow us to file a status report no later than April 1, 2010. We have also asked the Commission to suspend judgment on Exide's Motion for Stay and the Department's Opposition to Stay.

Facility Description
Exide operates a secondary lead smelting plant, known as the Exide Technologies Canon Hollow Recycling Center, located at 25102 Holt 250 Road, just off State Highway 111 in Forest City. The Canon Hollow plant has been in operation since at least 1975.
Schuylkill Metals Corp., the original facility owners, became a division of Exide Corp. in 1996. In 2000, Exide Corp. changed its name to Exide Technologies.
The Exide Technologies Canon Hollow Recycling Center recycles lead-acid storage batteries and other lead-bearing raw materials into new lead ingot. Exide also recovers battery acid, which is collected, filtered and recycled. Exide ships the plastic chips from the battery cases off-site.
Under the recently issued permit, Exide is allowed to continue to store whole batteries and containers in three areas, store bulk waste material in seven containment building areas, treat hazardous waste in a stabilization unit, dispose of hazardous waste produced by Exide in an on-site landfill and conduct post-closure care of a closed landfill.
