MISSOURI HAZARDOUS WASTE MANAGEMENT COMMISSION APPROVES BASF CORPORATION’S HAZARDOUS WASTE VARIANCE

JEFFERSON CITY, MO, MARCH 11, 2008 -- The Missouri Hazardous Waste Management Commission has approved BASF Corporation’s variance petition, with conditions. The approved variance order allows BASF more flexibility in using a letter of credit for financial assurance. The variance is in effect until Feb. 21, 2009.

BASF, located at 3150 Highway JJ in Palmyra, is Missouri's largest hazardous waste generator. BASF operates an agricultural chemical manufacturing facility that produces mainly herbicides and insecticides. BASF is currently permitted to operate four hazardous waste incinerators and two hazardous waste container storage areas. The container storage areas collect both off-specification and expired product returned through its product stewardship program and waste created during the production processes. BASF generated 122,540 tons of hazardous waste during the 2007 reporting year.

BASF petitioned for a variance from Missouri Hazardous Waste Management Regulation 10 CSR 25-7.264(2)(H)(6) on Dec. 31. According to state regulations, “This paragraph modifies the requirements for letters of credit per 40 CFR 264.143(d), 40 CFR 264.145(d), and 40 CFR 264.147(h), incorporated in this rule. Letters of Credit shall be issued by a state- or federal-chartered and regulated bank or trust association. If the issuing institution is not located in Missouri, a bank or trust association located in Missouri shall confirm the letter of credit and the confirmation and the letter of credit shall be filed with the department.”

The commission granted BASF a variance only from the portion of the regulation that relates to the confirming bank requirement. BASF remains subject to the portion of the regulation that requires the letter of credit to be issued by a state- or federal-chartered and regulated bank or trust association. 

The variance order is available on the department’s Web site at www.dnr.mo.gov/env/hwp/permits/notices.htm. Supporting documents are not available on the department’s Web site due to their size. The public can also review and copy the variance order and supporting documents at the Palmyra Bicentennial Public Library in Palmyra, during normal business hours, or by appointment at the Missouri Department of Natural Resources’ Hazardous Waste Program, 1730 E. Elm St., Jefferson City.
